A Eugene store clerk who shot a man allegedly attempting to rob the Duck N Go Market on Sunday will not face charges, according to the Eugene Police Department.
The incident took place around 5 p.m. at the Duck N Go Market on Commons Drive when Noah Sky, 21, reportedly entered the store, drew a gun, and pointed it at the clerk while demanding money, police spokesperson Melinda McLaughlin said. Fearing for his life, the clerk shot Sky, then immediately called 911.
Sky remained on the scene and was provided medical assistance before being transported to a local hospital for treatment. He was later taken into custody and is currently held at the Lane County Jail, police said.
On Wednesday, Sky was arraigned in Lane County Circuit Court on a charge of second-degree robbery. The charge alleges that Sky “unlawfully and knowingly” threatened the immediate use of physical force and claimed to be armed with a deadly weapon while attempting to steal.
Under Oregon law, deadly force is authorized if an individual has a reasonable fear of serious physical harm or death for themselves or a third party, McLaughlin said.
No other charges were pending in the case.
Sky remained in custody as of Thursday morning.
