ALBANY, N.Y. – A man from El Salvador admitted Thursday to threatening U.S. Attorney John Sarcone with a knife outside the Hilton Albany hotel. A judge sentenced him to 90 days in the Albany County jail.
Saul Morales-Garcia, 40, pleaded guilty to second-degree menacing and fourth-degree criminal possession of a weapon in a case that stems from an incident in which he admitted in City Court to displaying a knife and charging at Sarcone at around 10 p.m. on June 17.
The judge imposed a 90-day sentence and granted an order of protection. He told Morales-Garcia that if he was not a U.S. citizen, his plea may subject him to deportation or exclusion from the U.S., a statement Morales-Garcia acknowledged.
Morales-Garcia, who had previously been deported to his home country of El Salvador, was originally charged with second-degree attempted murder in the case, but Albany County District Attorney Lee Kindlon threw out that charge after reviewing video evidence from the case that he later released.
Kindlon said the evidence did not warrant a felony charge, and Sarcone agreed with DA’s decision to drop the attempted murder charge.
