Q. I have heard that we all have an absolute legal right to keep Easter chicks and bunnies. Is that really true?
A. The Allotments Act 1952 was passed during postwar austerity and mainly makes rules about allotments. However, section 12 of the act applies much more widely. Section 12(1) says “it shall be lawful for the occupier of any land to keep hens or rabbits in any place on the land” notwithstanding any provision to the contrary in “any lease or tenancy or in any covenant, contract or undertaking”.
The right to keep hens and rabbits also extends to the maintenance of “such buildings or structures on the land as reasonably necessary for that purpose”. This effectively means chicken coops and rabbit hutches.
